Document Description
Irvine Ranch Water District (IRWD) has entered into a Purchase and Sale Agreement (PSA) with Serrano Water District (SWD), for the purchase and sale of all of SWD's Irvine Lake property rights to IRWD, including all rights appurtenant to the property (water, mineral, and recreation rights and all associated infrastructure and related easements). The PSA also transfers to IRWD the Howiler Water Treatment Plant (HWTP) and SWD's rights in any untreated water conveyance facilities between Irvine Lake and the HWTP, including associated easements and rights ofwa.

Reasons for Exemption
The transfer of the properties and related rights from SWD to IR WD as contemplated in the PSA described above is exempt from the California Environmental Quality Act (CEQA) because the actions will involve the continued use of existing facilities, with negligible or no expansion of use beyond that currently existing, as authorized under the California Code of Regulations, Title 14, Chapter 3, Section 15301 (Class 1 "Existing Facilities"). Class 1 exempts from CEQA review any project for the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or fonner use beyond that existing at the time of the lead agency's determination. The PSA will transfer and assign to IRWD all of SWD's property rights in Irvine Lake (Santiago Creek Reservoir) land, water in storage, reservoir facilities, water rights, storage rights and recreation rights, and in the HWTP and its related facilities. IR WO will maintain the existing operations with negligible or no expansion of existing or former uses. In addition, pursuant to Section 15300.2(c) and 15301 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment.
