Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number EPIMS-TRI-43775-R1, pursuant to Section 1602 of the Fish and Game Code to Povang Noutru. The project is limited to six encroachments. Three encroachments are to upgrade existing culverts at stream crossings. Work for these encroachments will include excavation, culvert removal and replacement with new properly sized and aligned culverts, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion. One encroachment is to decommission an existing failed culvert stream crossing. Work will include excavation, culvert removal, reconstruction of the bed and banks of the stream and erosion control. One project is to restore ~100 feet of stream channel involving the removal of fill and reconstruction of the bed and banks. The other encroachment is to remove and dispose of or relocate any and all remaining diversion infrastructure associated with unpermitted surface water diversions described in two notices of violation.

Reasons for Exemption
The project will permit remediation and upgrading existing but unpermitted stream crossings and decommissioning unpermitted water diversions, involving minor alterations to land. The authorized work is associated with resolution of two CDFW notices of violation associated with illicit cannabis cultivation activities documented on June 30, 2022, and September 9, 2022.There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
