Reasons for Exemption
The Project is exempt under CEQA Guidelines Section 15061 (b)(3) which states that a project is exempt from CEQA if the project activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Reclamation issued an Environmental Assessment pursuant to the National Environmental Policy Act for the Long-Term Warren Act Contract on October 24, 2024, and the public comment period closed on November 24, 2024. PCWA assisted with the assessment and based on a review of the information gathered, has determined that the project would not have a significant effect on the environment. The Project is exempt under Class I, Section 15301 because it constitutes a continued use of existing facilities, with no expansion of use and is undertaken pursuant to the terms of PCWA 's existing water rights. The Contract is a water management operation using only existing facilities and existing water supplies and will not support new development or change in land use. The Contract does not establish a new permanent source of water supply.
