Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a Cultivation, Distributor, Distributor – Transport Only, and Manufacturing commercial cannabis license. The Project will consist of proposing the construction and operation of a cannabis manufacturing, distribution and cultivation facility located on Fresno County APNs 358-390-44, 358-032-58S, 358-260-24S, 358-390-34, 358-390-35, and 358-390-68. The total Project site is approximately 60.33 acres and is expected to employ 40 people. Estimated water use is approximately 30,000 gallons per day. Of that total, approximately 14,000 would be from the City’s water system and 16,000 would be pumped via an existing private agricultural well; the two water systems would not be interconnected. The manufacturing site would include an approximately 20,000 square foot, 2-story building containing administrative offices and cannabis by-product extraction equipment. Wastewater generated by the Project would be limited to that from the restrooms located within the manufacturing facility. Runoff from irrigation and stormwater would be accommodated onsite in retention basins.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. The City of Parlier certified an amendment to the City’s General Plan Environmental Impact Report (EIR) (State Clearinghouse # 2009011089) in 2009. In 2017 the Parlier City Council adopted Ordinance No. 2017-03, creating the City’s Cannabis Control Ordinance (Parlier Municipal Code [PMC] Chapter 18.55) and further amending the text of the PMC to allow commercial cannabis operations within the M-1 Manufacturing zone, subject to the provisions of the Cannabis Control Ordinance, along with other specified agricultural activities. The City of Parlier determined cannabis activity to be similar to other agricultural and commercial uses, and the City of Parlier determined that zoning to authorize such cannabis activities did not involve new, or increased severity of, significant environmental effects beyond those identified in the City’s General Plan and updates. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
