Reasons for Exemption
This action is consistent with Section 15061 (b)(3), The Common Sense Exemption, whereas the allowance to update the site plan can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This is because the Minor Modification is merely updating a site plan for by-right use on the subject parcel/s that is/are not subject to a CEQA review. Further, this use has already been through a CEQA review by way of a Notice of Exemption that was approved by the Tulare County Planning Commission on October 24, 2018 (Resolution No. 9531). The Notice of Exemption for PSP 18-078 utilized Title 14, Cal. Code Regulations Section 15303, Class 3, pertaining to New Construction or Conversion of Small Structures. The beneficiary of this Project is the property owner and the environment because the solar array will reduce both electricity costs and emissions that would be generated to produce electricity. Therefore, the application of CEQA Section 15061(b)(3) is applicable and appropriate for this Project.
