Reasons for Exemption
This project is categorically exempt from the CEQA, as a Class 32 "Infill" Categorical Exemption in that (a) the Project is consistent with the City's General Plan designation and all applicable General Plan policies as well as with applicable zoning designation and regulations because (i) the Project site is within an Affordable Housing Overlay Zone (AHOZ),is identified in the City's Housing Element, and will include the development of affordable housing, and (ii) the Project includes 60 units, which meets the target density in the AHOZ of 30 units/acre maximum allowable density for this Property; (b) the Project is occurring within the City limits on a Project site that is 2.06 acres which is no more than five acres and substantially surrounded by developed urban uses (and the land is disturbed); (c) the Project site has no value as a habitat for endangered, rare, or threatened species; (d) approval of the Project does not result in any significant effects relating to traffic, noise, air quality, or water quality; and (e) the Project site is adequately served by all required utilities and public services. None of the exceptions to CEQA's Class 32 categorical exemption apply here (see, CEQA Guidelines Section 15300.2), and specifically, no unusual circumstances exist that would result in reasonable possibility that the Project will have a significant impact on the environment.
