Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 1 and Class 3; California Code of Regulations, Title 14, Section 15301 and Section 15303
Reasons for Exemption
The project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Class 1, Existing Facilities, Section 15301 and Class 3, New Construction or Conversion of Small Structures, Section 15303 of the State CEQA Guidelines. Specifically, the request involves the negligible expansion of an existing restaurant use at an existing building and a change of use from residential to commercial, in order to expand that use (with minor exterior changes to the existing structure), which is consistent with both the definition of existing facilities and the conversion of small structures. There are no unusual circumstances or other applicable exceptions to the Class 1 or Class 3 exemptions. Thus, no further environmental review is necessary.
