Document Description
The Department of Pesticide Regulation is initiating a reevaluation of pesticide products containing the active ingredient paraquat dichloride as a result of the California Legislature recently adopting Assembly Bill 1963 (Chapter 688, Statutes of 2024), which added Food and Agricultural Code (FAC) sections 14085 and 14086. Specifically, FAC section 14086 requires DPR to complete a reevaluation of paraquat dichloride by January 1, 2029. During the reevaluation, DPR will determine if additional restrictions on use, up to and including cancellation or suspension, are necessary.

See attachment. DPR's initiation of the reevaluation of pesticide products containing the active ingredient paraquat dichloride is a ministerial project exempt from the requirements of the California Environmental Quality Act (CEQA). The California Legislature recently adopted Food and Agricultural Code sections 14085 and 14086 which mandates DPR to complete a reevaluation by January 1, 2029. Therefore the law dictates a specific action by DPR and DPR lacks the discretion to deny the project (not initiate a reevaluation) or limit the scope (active ingredient). As a result, this decision to initiate a reevaluation is a ministerial project exempt from CEQA.
