Reasons for Exemption
None of the exceptions in CEQA Guidelines Section 15300.2 to the categorical exemption(s) apply to the Project. Exceptions Narrative for Class 32 Categorical Exemption There are five (5) Exceptions which must be considered in order to find a project exempt under Class 32: (a) Cumulative Impacts; (b) Significant Effect; (c) Scenic Highways; (d) Hazardous Waste Sites; and (e) Historical Resources. Planning staff evaluated all the potential exceptions to the use of Categorical Exemptions for the proposed project and determined that none of these exceptions apply as explained below: a. Cumulative Impacts. All exemptions for these classes are inapplicable when the cumulative impact of successive projects of the same type in the same place, over time is significant. There is one other TOC project within a 500-foot radius of the site, at 3030 West 12th Place. This request, filed on November 2, 2022, is for a new five-story, 18-unit residential building. The case is currently on hold. While there could potentially be a succession of known projects of the same type and in the same place as the subject project, all projects are subject to the citywide Regulatory Compliance measures as noted above, which regulate impacts related to air quality, noise, and geology to a less than significant level. There is no evidence to conclude that significant impacts will occur based on past project approvals or that the proposed Project's impacts are cumulatively considerable when evaluating any cumulative impacts associates with construction noise and transportation/traffic in the surrounding area. Therefore, in conjunction with citywide RCMs and compliance with other applicable regulations, no foreseeable cumulative impacts are expected. b. Significant Effect Due to Unusual Circumstances. A categorical exemption shall not be used for an activity where there is a reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances. The project proposes the construction of a five-story, 56-foot tall mixed-used building, comprised of 28 residential dwelling units, totaling 12,867 square feet of floor area on an approximately 6,209 square-foot lot in the C2-1VL-HPOZ-CPIO zone. All surrounding properties are developed with residential, commercial, or institutional buildings. There are no known unusual circumstances which may lead to a significant effect on the environment. c. Scenic Highways. A categorical exemption shall not be used for a project which may result in damage to scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway. The only State Scenic Highway within the .City of Los Angeles is the Topanga Canyon State Scenic Highway, State Route 27, which travels through a portion of Topanga State Park. The portion of State Route 27 which travels through the Los Angeles city limits is approximately 25 miles from the subject site. Therefore, the subject site will not create any impacts within a highway designated as a state scenic highway. d. Hazardous Waste Sites. A categorical exemption shall not be used for a project located on a site which is included on any list complied pursuant to Section 65962. 5 of the Government Code. According to Envirostor, the State of California's database of Hazardous Waste Sites, neither the subject site, nor any site within a 1,000-foot radius of the subject site, is identified as a hazardous waste site. e. Historical Resources. A categorical exemption shall not be used for a project which may cause a substantial adverse change in the significance of a historical resource. The subject site is a non-contributing element to the Harvard Heights HPOZ and has been vacant since the original building was demolished in 1990. The project has been designed to be compatible with the historic commercial buildings in the district and meets the Secretary of the Interior's Standards and the Harvard Heights HPOZ Preservation Plan. Compatible design elements include a reference to Neoclassical architecture, the use of step backs on the third through fifth floors, and incorporation of materials similar to those used during the period of significance. Therefore, the project will not cause a significant adverse impact to any historic resource, including the historic district itself.
