Reasons for Exemption
The proposed improvements are considered Categorically Exempt from CEQA pursuant to Title 14 CCR Section 15301. The proposed project consists of the contractual right to transfer water through the continued operation of existing water supply diversion, storage and conveyance facilities and would not expand Napa or Tulare water supply use. Construction of new, expanded or modified facilities is not required to implement the project. None of the exceptions defined in Section 15300.2 would occur. The project is not located near a scenic highway or on a hazardous waste site. There is no reasonable possibility that the activities related to the proposed project will have a significant effect on the environment due to unusual circumstances. Also, no significant cumulative impacts are anticipated over time due to successive projects of the same type in the same place.
