Document Description
The proposed project consists of Development Code Amendments. Commercial Cannabis Cultivation: The adopted ordinance amends the Vista Business Park Specific Plan (VBPSP) to allow commercial cannabis cultivation. Cultivation includes any activity involving the planting, growing, harvesting, drying, curing, grading, or trimming of cannabis. The proposed amendments would allow up to three commercial cannabis cultivation locations within Area “B” of the VBPSP, subject to a Special Use Permit (SUP), and subject to new licensing requirements in Chapter 5.97 of the Vista Municipal Code.; and, Temporary Cannabis Events at Brengle Terrace Park: The adopted ordinance amends the Vista Municipal Code Chapter 8.12 Smoking in Public Places, and Chapter 12.08 Park and Recreation Area Use Regulations, and Chapter 12.13 Park Events, relating to temporary cannabis events at Brengle Terrace Park, have all been prepared at the direction of the City Council to establish reasonable and straightforward regulations for permitting up to two temporary cannabis events (which may include consumption) per calendar year at Brengle Terrace Park while ensuring compatibility with adjacent uses and protecting health, safety and general welfare of participants and the overall community. Chapters 8.12 and 12.08 are being updated to allow smoking of cannabis and/or cannabis consumption at temporary cannabis events that have gone through the required approval process. Also, a resolution was adopted creating a fee for pre-screening applications for temporary cannabis events

Reasons for Exemption
The proposed project amending the Vista Business Park Specific Plan (VBPSP) to allow commercial cannabis cultivation is exempt under State CEQA Guidelines Section 15161(b)(3) because the amendments would establish a discretionary permit process wherein subsequent environmental review of commercial cannabis cultivation applications would occur. The proposed project is exempt Section.; and, The proposed code amendments to create a process to allow temporary cannabis events are exempt under State CEQA Guidelines Section 15301 (Existing Facilities), which allows the licensing of temporary cannabis events at an existing public facility with negligible or no expansion of the existing public facility use, Section 15304 (Minor Alterations to Land), which allows for minor, temporary use of land that has negligible or no permanent effects on the environment, and Section 15311 (Accessory Structures), which allows for construction or placement or minor structures accessory to existing commercial, industrial, or institutional facilities, including, but not limited to, temporary use items in publicly owned facilities or other facilities designated for public use; and none of the exceptions listed in CEQA Guidelines Section 15300.2 would apply. The adopted fee for pre-screening applications for temporary cannabis events are exempt pursuant to CEQA Guidelines Section 15061(b)(3), the “Common Sense” exemption, because there is no possibility that the proposed amendments may have a significant effect on the environment.
