Document Description
Proposal to construct the following: 4’ x 30’ stairs and walkway, 4’ x 21’ pier, 4’ x 12’ landing, two 3’ x 24’ gangways, 14’ x 22’ swim platform, 21’ x 34’ covered boatlift, two PWC lifts, and driving 13 metal pilings. Construction is planned for October 15 to December 31, but the owner may request to work outside of that window. If work occurs outside of the that window, electro-surveying will be done and if hitch is detected, work must occur within the window. The project is in an area with a steep slope and large rocks. The pier part of the structure begins landward of 7.8, and the projected depth of lakebed at the lakeward extent of the proposed structure is approx. -16.2 ft Rumsey. Tules are not present within or adjacent to the project area. There are numerous large pines in this area.

Reasons for Exemption
Pursuant to the California Code of Regulations, Title 14, Division 6, Chapter 3, Section 15303 Class 3 New Construction or Conversion of Small Structures will be applied to the proposed project. The project will construct small new accessory structures that will include the following: stairs and walkway, pier, landing, gangways, swim platform, boatlifts, and pilings. The County has concluded that no known impacts covered in the exceptions listed in the California Code of Regulations, Title 14, Division 6, Chapter 3, Section 15300.2 would occur from the proposed project based on the following: a) Tules are not present within or adjacent to the project area. Construction is planned to occur from October 15 to December 31 to avoid the Clear Lake hitch (Lavinia exilicauda chi). If the applicant works outside of the work window, they will need to comply with CDFW’s requirements. With exception of the Clear Lake hitch (Lavinia exilicauda chi), the CNDDB database has no other records of federal or state listed endangered or threatened animal or plant species; b) Although there are other lakebed projects that will occur prior to, at the same time, and after the proposed project, the majority would be temporary with no or minimal expansion which is sometimes associated with an increase of use; c) There are no known unusual circumstances that might result in significant effects on the environment; d) There are no officially designated state scenic highways according to the Caltrans List of Officially Designated County Scenic Highways; e) There are no recorded hazardous waste sites according to the State’s Envirostor database; f) The project site is not on the California Historical Resources list and there are no other known historical resources. Due to new disturbance, a Cultural Resource Assessment was prepared, and it concluded that no significant cultural sites exist within the project area, and it was recommended that the proposed project be approved as planned. The Lake County Community Development Department has determined that the project will not have a significant effect on the environment and is, therefore, exempt from the provisions of CEQA.
