Reasons for Exemption
The proposed project involves the demolition of an existing restroom building and adjacent hardscape, and the construction of a new 949 square foot restroom building, 687 square foot shade structure, and site improvements including landscape, decomposed granite paving, a drinking fountain, picnic tables, litter receptacles, and a concrete path to provide access to the restroom and park facilities within the footprint of the existing Rio Vista Park property. Class 2 consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. Class 3 consists of construction and location of limited numbers of new, small facilities or structures where only minor modifications are made in the exterior of the structure such as water main, sewage, electrical, gas, and other utility extensions of reasonable length to serve such construction. Class 11 consists of construction or placement of minor structures accessory to existing facilities, including small parking lots and placement of similar items in generally the same locations from time to time in publicly owned parks designed for public use. The proposed project, as described above, meets these criteria. Additionally, pursuant to Section 15300.2(c) of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project is categorically exempt from the provisions of CEQA.
