Reasons for Exemption
Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical.There are six (6) Exceptions which the City is required to consider before finding a project exempt under Class 15303: (a) Location; (b) Cumulative Impacts; (c) Significant Effect; (d) Scenic Highways; (e) Hazardous Waste Sites; and (f) Historical Resources. The site is zoned C2-1D, located in the Hollywood Community Plan area, with a General Plan Land Use Designation of Highway Oriented Commercial. As shown in the case file, the project is consistent with the applicable Hollywood Community Plan designation and policies and all applicable zoning designations and regulations. The project is an existing commercial use on a
10, 172-square-foot site zoned for commercial uses. It is currently developed with an existing twostory building, and the 2,429-square-foot bar makes up a portion of the first floor. The applicant is providing 12 on-site parking spaces. No construction is proposed to change the exterior of the building. There is not a succession of known projects of the same type and in the same place as the subject project. As mentioned, the project proposes the continued sale and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with patron dancing and live
entertainment within the existing bar (Akbar) and would not result in any additional square footage to the existing structure or site. Thus, there are no unusual circumstances which may lead to a significant effect on the environment.Lots adjacent to the subject site are developed with neighborhood commercial uses and
residential uses in an urbanized area. The project site is previously disturbed and surrounded by development and therefore is not, and has no value as, a habitat for endangered, rare or threatened species. It is currently developed with an existing two-story building with an existing bar and a restaurant in a separate tenant space and is surrounded by development. Therefore, it is not, and has no value as, a habitat for endangered, rare or threatened species. No additional square footage is proposed for the project. Furthermore, the project does not exceed the threshold
criteria established by LADOT for preparing a traffic study. Therefore, the project will not have any significant impacts to traffic. Interim thresholds were developed by DCP staff based on CalEEMod model runs relying on reasonable assumptions, consulting with AQMD staff, and surveying published air quality studies for which criteria air pollutants did not exceed the established SCAQMD construction and operational thresholds. Therefore, the project meets all of the Criteria for Class 1. The subject property is not located within a fault zone; however, it is approximately 0.14 kilometers from the Upper Elysian Park Fault Zone. Additionally, the only State Scenic Highway within the City of Los Angeles is the Topanga Canyon State Scenic Highway, State Route 27, which travels through a portion of Topanga State Park. The subject site is approximately 18 miles east of the Topanga Canyon State Scenic Highway. Therefore, the subject site will not create any impacts within a designated state scenic highway. According to EnviroStor, the State of California's database of Hazardous Waste Sites, neither the subject site, nor any site in the vicinity, is identified as a hazardous waste site. Thus, the location of the project will not result in a significant impact based on its location. The project site has not been identified as a historic resource by local or state agencies. It is not a contributor to a district determined eligible for the National Register. Based on this, the project will not result in a substantial adverse change to the significance of a historic resource, and this exception does not apply.
