Renewal and Approval of Contract MA-299-20010242 (Contract) with Ron Dietz, Inc. dba Dietz Hydroseeding Company (Dietz Hydroseeding Company) for hydroseeding services at the County's solid waste landfills supports OC Waste & Recycling’s (OCWR) requirement to comply with RWQCB and NPDES standards to protect landfill areas from erosion and prevent silt from migrating into drainage structures, waterways and sensitive habitat, minimize slope instability, and improves aesthetics. Source protection of erodible soils limits silt buildup in landfill desilting basins and minimizes labor and equipment time for annual maintenance. The proposed project will not result in any significant impacts to the environment.

Reasons for Exemption
The proposed action was previously determined to be Categorically Exempt from CEQA pursuant to Sections 15301, 15304, 15307 and 15308 (Classes 1, 4, 7 and 8) of the CEQA Guidelines, on October 8, 2019, when it was originally approved. CEQA Guidelines Section 15301, Class 1 (Existing Facilities) provides for the exemption of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographic features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. In addition, CEQA Guidelines Section 15304, Class 4 (Minor Alterations to Land) provides for the exemption of minor alterations to land. CEQA Guidelines Section 15307, Class 7 (Actions by Regulatory Agencies for Protection of Natural Resources), provides for the exemption of actions taken by a public agency for the protection of natural resources. CEQA Guidelines Section 15308, Class 8 (Actions by Regulatory Agencies for Protection of the Environment), provides for the exemption of actions taken by a public agency for the protection of the environment. This action will allow for the renewal of an existing contract for continued hydroseeding services for the purpose of environmental protection at existing landfills in the form of erosion control, slope stabilization and minimization of siltation at Orange County Landfills which is consistent with a Class 1, Class 4, Class 7 and Class 8 Categorical Exemption determination. The proposed action results in no new findings and continues to be exempt from CEQA pursuant to the identified Categorical Exemptions.
