Section 15301 of the State CEQA Guidelines, titled “Existing Facilities,” reads as follows: “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The types of “existing facilities” itemized below are not intended to be all-inclusive of the types of projects that might fall within Class 1. The key consideration is whether the project involves negligible or no expansion of use.” The proposed renovation of a vacant 6,650 sq. ft. restaurant into three tenant suites and the construction of a 350 sq. ft. outdoor dining area is a negligible expansion to the existing use. The proposed minor modifications to the building façade do not involve a significant expansion of the existing use. Therefore, the project is exempt from further review under CEQA.
