Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code, Section 26012, approved a commercial cannabis Retail license submitted on 04/24/2024, by CV McHenry, Inc. The Project will consist of a cannabis retail facility at 4213 McHenry Ave, APN 046-008-013-000, within the Planned Development (P-D 155) zoning district. The project will operate within an existing 8,684-square foot (SF) building within three suites on a lot area of 26,571 SF. There will be delivery and distribution activities as well. Retail and delivery will occur in Suite E of the building and occupy 1,917 SF. Retail activities will operate within 745 SF. Suite C will have distribution and packaging activities. Suite B will be administration work. Operation hours are from 8:00AM to 8:00PM, Monday through Sunday. The maximum anticipated number of employees is 17. A total of 8 employees maximum will operate under retail/delivery activities, and a maximum of 5 employees will operate under distribution activities. There will be an estimated one vehicle delivery/shipment per day. The project site is currently operating under retail license, C10-0000557-LIC, which will be surrendered and replace by C10-23-0000214-APP upon its approval.

The Department of Cannabis Control has determined that the project is a Class 1 Categorical Exemption project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. None of the exceptions to this exemption defined in Section 15300.2 apply.
