Document Description
[Continued Project Title]: [Vulnerability Assessment in accordance with Senate Bill 1035; and adding General Plan Chapter 12 Environmental Justice Element in accordance with Senate Bill 1000.] General Plan Amendment 22-001: Amendment to the Public Safety Element. In 2018, the State passed Senate Bill No. 1035 which requires the Public Safety Element to be reviewed not less than once every eight years and revised as necessary to address climate change and resiliency strategies. The intention is to identify new information relating to flood, fire, and other climate hazards not available during the previous revision of the safety element. New Environmental Justice Element. In 2016, the State passed Senate Bill No. 1000 requiring cities and counties that have “disadvantaged communities” to incorporate environmental justice policies in their General Plans, either in a separate element or throughout the other elements. The Environmental Justice Element will establish objectives that help improve air quality, food access, safe and sanitary homes, physical activities, promote civic engagement, and prioritize improvements that address the needs of the community.

Reasons for Exemption
The project is exempt from provisions of the California Environmental Quality Act (CEQA) under CEQA Guidelines Pursuant to Section 15282(s), which states, any action necessary to bring a general plan or relevant mandatory element of the general plan into compliance pursuant to a court order as set forth in Section 65759 of the Government Code. Furthermore, the adoption of the Safety and Environmental Justice Elements is exempt from CEQA review, pursuant to Section 15061(b)(3), as it can be seen with certainty that there is no possibility that this activity may have a significant effect on the environment. GPA21-001 in itself does not relate to any physical project and will not result in any physical change to the environment and does not affect the land use or density limitations of the General Plan, except as superseded by State law. Therefore, it can be seen with certainty that there is no possibility that this general plan text amendment may have a significant adverse effect on the environment, and therefore, the adoption of this amendment is exempt from CEQA pursuant to Section 15061(b)(3) and Section 15282(s) of the CEQA Guidelines.
