Reasons for Exemption
The proposed action is not subject to the California Environmental Quality Act (Public Resources Code section 21000 et seq.) ("CEQA") because it does not qualify as a "project" under CEQA, as defined in Section 15378 of the CEQA Guidelines. The proposed action includes approval of a professional service agreement to prepare the appropriate CEQA documentation for the 2400 Juanita Way road extension project. Such action will not result in a physical change in the environment, and therefore is not subject to CEQA. Therefore, the City Council (CC) has determined that further environmental evaluation is not required because: The project is not subject to CEQA because it "does not involve the exercise of discretionary power," or "will not result in a direct or reasonably foreseeable indirect physical change in the environment," or "is not a project as defined in Section 15378 of the CEQA guidelines." (Sections 15060(c)(1),(2), & (3)).
