This Project is statutorily exempt from the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21080.21 (Application of division to Public Right-Of-Way Pipeline Projects Less Than One Mile in Length). Here, the Project does not exceed a mile in length and involves the installation of a new pipeline in the public right-of-way. Even if this Project was found to be a "project" as defined by CEQA, this Project is categorically exempt from CEQA pursuant to State CEQA Guidelines Section 15303(d) (Class 3 exemption). The Class 3 exemption applies in part to "Water main, sewage, electrical, gas, and other utility extensions, including street improvements, of reasonable length to serve such construction." Again, the Project involves installation of a new water pipeline and does not exceed a mile. None of the exceptions found in 15300.2 would apply to the Project.
