Document Description
The Project is a focused amendment to the adopted and certified 6th Cycle Housing Element for the 2021-2029 planning period (PA2022-0245). The amendment provides targeted revisions to Section 3 (Housing Constraints, Resources, and Affirmatively Furthering Fair Housing) and Section 4 (Housing Plan) of the Housing Element and approval of the CEQA Notice of Exemption. The City of Newport Beach General Plan 2021-2029 6th Cycle Housing Element (PA2022-0245) covering the period 2021-2029 (2021-2029 Housing Element) was adopted by the City Council on September 13, 2022, and was subsequently found in compliance with Slate Housing law (certified) by the State of California Department of Housing and Community Development (HCD) on October 5, 2022. The revisions to the Section 3 (Housing Constraints, Resources, and Affirmatively Furthering Fair Housing) and Section 4 (Housing Plan) of the Housing Element modify the narrative and Implementing actions related to removing the EP 2 5 2024 requirement for a vote of the electorate pursuant to City of Newport Beach Charter Section 423. The balance of the 2021-2029 Housing Element, including the sites analysis and all Policy Actions, is unchanged. The State of California Department of Housing and Community Development (HCD) in its letter to the City dated August 20, 2024 noted the 2021-2029 Housing Element remains in compliance with State Housing Element Law with the modifications.

The action Is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c}(2) and 15060(c)(3) of the CEQA Guidelines as well as City Council Policy K-3 (Implementation Procedures for the California Environmental Quality Act) because this action will not result in a physical change to the environment, directly or indirectly. The action is also exempt from environmental review under CEQA pursuant to Class 21 as set forth In Section 15321 of the CEQA Guidelines, which exempts actions that Involve enforcement of a law, general rule, standard, or objective, administered or adopted by a regulatory agency. Further, all significant environmental concerns for the City of Newport Beach Housing Element and its implementation have been addressed In a previously certified environmental document (Housing Element Implementation Program Environmental Impact Report -State Clearinghouse Number 2023060699).
