Reasons for Exemption
The Planning Division of the Community and Economic Development Department conducted an Environmental evaluation connected with the proposed Subdivision 24-01 (Tentative Parcel Map 20839) and Administrative Development Permit 23-008 and is found to be Exempt under Section 21080(b)(4) of CEQA and State CEQA Guidelines Section 15269 (Emergency Projects).
The city adopted Resolution No. 2023-028, declaring a Homelessness State of Emergency within the City. Because a State of Emergency exists within the City and given the magnitude of the homelessness and related shelter crisis, the Project is necessary to mitigate the declared emergency pursuant to Public Resources Code Section 21080(b)(4) and State CEQA Guidelines Section 15269. The homelessness crisis currently exists, and lengthy environmental review would create a risk to public health, safety, and welfare by preventing the interim housing of 140 individuals and related services. The Project is also exempt from CEQA pursuant to Government Code Section 65660 as a Low Barrier Navigation Center. Government Code Section 65660 provides for Low Barrier Navigation Centers (LBNC) and specifies that an LBNC is a use by right, which has the same definition used in Government Code Section 65583.2(i) that states local government review may not require a conditional use permit or other discretionary local government review or approval that would constitute a "project" for purposes of CEQA. Additionally, as a supportive housing project that satisfies all the objective planning standards of Government Code Section 65651, approval of the Project is statutorily exempt from the CEQA.
