Document Description
The Board of Harbor Commissioners approved a supplement to the existing Master Joint Revocable Permit (MJRP) 19-15 with Crown Castle Fiber LLC, to allow for the placement of an overhead/aerial fiber optic line over the joint ports’ former Southern Pacific San Pedro Branch railroad right-of-way on existing poles located outside the right-of-way. The agreement will be effective upon the last execution by the Chief Executive Officer and Executive Director of the respective Harbor Departments of the cities and is revocable by either party upon sixty (60) days’ notice to the other parties.

Section 15301 Existing Facilities (Class 1): The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project consists of the issuance of a supplement to Master Joint Revocable Permit to allow placement of an overhead fiber optic line across the former UPRR San Pedro Branch Right-of-Way to existing poles located outside of the Joint Port’s property. The project involves negligible expansion of existing or former use. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15301 (Existing Facilities); Therefore the Project is exempt from CEQA and no further environmental review is required.

The installation of a new aerial communications fiber cable line on existing power poles constitutes the installation of small new equipment in small structures. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15303 (New Construction or Conversion of Small Structures); Therefore the Project is exempt from CEQA and no further environmental review is required.
