Reasons for Exemption
Section 15269(a) exempts projects for maintaining, repairing, restoring, demolishing, or replacing property damaged in a disaster area where a state of emergency is declared by the Governor under the California Emergency Services Act, starting with Section 8550 of the Government Code. This includes projects that remove, destroy, or alter historical resources posing an imminent threat to public safety or adjacent property, or those determined by the State Office of Historic Preservation under Section 5028(b) of the Public Resources Code. The proposed project involves in-kind repair and rehabilitation of existing roadways and replacement of damaged culvert(s) by the Camp Fire, a declared disaster by the California Governor and the U.S. President on November 8, 2018.
