Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code, Section 26012, approved a commercial cannabis Retail license submitted on 11/05/2023, by 3185 Mission, LLC. The Project will consist of a cannabis retail facility located at 3185 Mission St (APN 5609-015) in a 2,885 square foot (SF) building on a 2,086 (SF) parcel (0.05 acres) within a Commercial Zone (Mission Bernal Neighborhood Commercial District). The project will take place in the ground-floor commercial space (1,350 SF) that was previously used as a firearms retail store. The hours of operation are 6:00 AM to 10:00 PM and hours have potential to be reduced after the first 6 months of operation depending on sales volume. Anticipated number of employees is 3 employees and up to 5 employees on busier days. Inventory deliveries are expected to be 2 to 3 times a week. No expansion of the structure is proposed. The project is serviced by public utilities.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 1 Categorical Exemption project and a Class 3 Categorical Exemption project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. None of the exceptions to this exemption defined in Section 15300.2 apply. Class 3 Categorical Exemptions consist of the construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. None of the exceptions to this exemption defined in Section 15300.2 apply.
