Document Description
The California Department of Fish and Wildlife has executed Streambed Alteration Agreement No. EPIMS-SBA-49401-R5, pursuant to Section 1602 of the Fish and Game Code to Max DeVroome. The Project is limited to remedial actions to resolve Notices of Violation issued by the County of Santa Barbara Planning and Development Department and the California Department of Fish and Wildlife for the unpermitted installation of a 100-foot long, 24-inch diameter, HDPE (high-density polyethylene) culvert in an unnamed tributary of Mission Creek. The remedial actions include: removal of a 60-foot long section of the unpermitted culvert and removal of the fill placed on the sides and top of the culvert. New headwalls will be constructed and the inlet and outlet of the remaining 40-foot long culvert. These headwalls will be constructed out of sandstone rock and placed in mortar. Additionally, ungrouted sandstone boulders will be used as riprap at the culvert outlet to dissipate storm water energy. In order to restore vegetation, 0.21 acres will be revegetated with a native seed pallet including 12 coast live oak trees.

Reasons for Exemption
Class 1 – Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. This Project will result in minor alterations to the topographical features of the site and minor alterations to an existing culvert by removing a portion of it. Class 4 – Class 4 consists of minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes. The Project involves minor revegetation and the only grading to be completed will return the area to its original condition. Three trees are designated for removal, but they are either dead or in poor health. Class 21 – Class 21 consists of: (a) Actions by regulatory agencies to enforce or revoke a lease, permit, license, certificate, or other entitlement for use issued, adopted, or prescribed by the regulatory agency or enforcement of a law, general rule, standard, or objective, administered or adopted by the regulatory agency. Such actions include, but are not limited to, the following: (1) The direct referral of a violation of lease, permit, license, certificate, or entitlement for use or of a general rule, standard, or objective to the Attorney General, District Attorney, or City Attorney as appropriate, for judicial enforcement. (2) The adoption of an administrative decision or order enforcing or revoking the lease, permit, license, certificate, or entitlement for use or enforcing the general rule, standard, or objective. The Project is to remediate a violation of Fish & Game Code section 1602.
