Document Description
Los Angeles County Public Works is proposing the use of the Construction Manager at Risk (CMAR) project delivery method for the Bassett High School Stormwater Capture Project. The CMAR acts as a consultant to the County in the development and design phases (preconstruction) of the project, including preconstruction services that involve feasibility and planning studies, such as exploratory excavation for utilities and soils investigations, and will be accountable for construction performance, trade subcontracts, and the construction work. The CMAR will work with Public Works on the design of the project, which proposes a diversion system to capture and divert stormwater and urban runoff to a regional stormwater capture facility located at Bassett High School, educational outreach, and aboveground recreational improvements. The project will return to the Los Angeles County Board of Supervisors for approval when full funding for the proposed project is identified.

Reasons for Exemption
The Award CMAR, Establish Capital Project and Approve Project Budget activities are not a project under CEQA pursuant to Section 21065 of the Public Resources Code and Section 15378(a) and (b)(5) of the State CEQA Guidelines. The award and authorization for execution of a CMAR consultant service agreement, delegation of authority to supplement the agreement amount and related actions are statutorily exempt from Public Resources Code Section 21102 and State CEQA Guidelines section 15262 because they involve preconstruction activities that involve feasibility and planning studies, such as exploratory excavations and soils investigations for possible future actions which the County has not approved, adopted or funded and for which environmental factors have been considered. The actions are also categorically exempt under Sections 15304 and 15306 of the State CEQA Guidelines and Classes 4 and 6 of the County of Los Angeles Environmental Document Reporting Procedures and Guidelines for minor alterations to land and information collection. The Project is not located in a sensitive environment and there are no significant cumulative impacts, unusual circumstances, damage to scenic highways, listing on hazardous waste sites pursuant to Government Code Section 65962.5, or indications that the project may cause a substantial adverse change in the significance of a historical resource that would make the exemption inapplicable based on the record of the proposed activities.
