Reasons for Exemption
Class 1 projects consist of operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project would involve repair or replacement of existing wastewater conveyance infrastructure. The project would not expand the use or increase the capacity of the existing wastewater system. Therefore, the Class 1 exemption is applicable. Class 2 projects consist of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The project would involve repair or replacement of existing wastewater conveyance infrastructure. The project would not expand the use of the existing wastewater system, and the repaired or replaced pipelines would be generally located in the same location as existing infrastructure and would have the same purpose and capacity as the existing system. Therefore, the Class 2 exemption is applicable.
