Exempt Status
Other
Type, Section or Code
Sec. 15061 (b)(3)
Reasons for Exemption
This matter is exempt from the requirements of CEQA because the activity is not a "project" as defined under CEQA, as it can be determined with certainty that the formation of Community Facilities District No. 2024-1, together with the tax and bond issuance and sales, will not have a significant effect on the environmental (see 14CCR 15061(b)(3)); see also Kaufman & Broad - South Bay v. Morgan Hill (1992) 9 Cal.App.4th464). The Board of Education of the Colton Joint USD has made such a finding in conjunction with the proceedings conducted in regard to the proposed formation of Community Facilities District no. 2024-1.
