Reasons for Exemption
Section 15302 Replacement or Reconstruction (Class 2): The Class 2 Categorical Exemption consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. In order to continue safe operations at Pier 16, SpaceX is proposing to replace eleven existing fendering systems by removing approximately 17 to 32 creosote-treated timber piles with up to 44 wide flange steel piles and would largely do so as a like-for-like replacement, with some minor adjustments to the total number and location of piles to incorporate the latest engineering design and technology available. The new steel piles will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. SpaceX is also proposing to repair up to 50 potholes of varying size on the dock surface.
The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of Categorical Exemption CEQA Guidelines Section 15302 (Replacement or Reconstruction); therefore, the Project is exempt from CEQA and no further environmental review is required.
