Reasons for Exemption
The proposed project is exempt from CEQA pursuant to Section 15302, Class 2, which consists of the replacement and construction of existing structures and facilities, and Section 15332, Class 32, which consists of projects characterized as infill development meeting the following conditions:
1. The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations.
The project is consistent with the General Plan, which designates the parcel Town Center, encourages commercial development in the district, and is consistent with the proposed amendments of the Tahoe Valley Area which allows all of the proposed uses.
2. The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses.
The project is a previously developed property located within the city limits of South Lake Tahoe and is 0.525 acres in size.
3. The project site has no value, as habitat for endangered, rare or threatened species.
The project site has no known value as a habitat for endangered, rare or threatened species. The majority of the parcel has been verified by TRPA as high-capability land (Class 7), and there is a small stream environment zone contained to the northwest portion of the parcel. The parcel is currently 100% hard coverage and would not provide a suitable habitat for endangered, rare or threatened species.
