Notice of Exemption

Exempt Status
Statutory Exemption
Type, Section or Code
Section 15061(b)(3)
Reasons for Exemption
The proposed zone code amendment will only increase the maximum building height requirement for an approximately 541-acre portion of the A zone district. Buildings within the A zone district are already allowed to be located within the district provided they are an allowed, or conditionally allowed, use and less than 45 feet in height. Other structures, such as silos, windmills, and communication antenna and towers, are currently allowed to exceed this height with approval by staff as a ministerial action. This zone code amendment will only increase the maximum building height requirement for a portion of the A zone district and would not cause any physical change to the environment. Therefore, the zone code amendment is exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines.
