Reasons for Exemption
The EJ Element is a community-wide plan focused on improving environmental conditions in the Priority Communities. It outlines a high-level vision for community health and wellness; it does not propose site-specific development activities. Any site-specific activities implemented in the future would require their own environmental analyses.
As such, the project would not “result in a direct or reasonably foreseeable indirect physical change in the environment” (CEQA Guidelines section 15060(c)(2)). It is also exempt from environmental review pursuant to the “common sense exemption” “[w]here it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment” (CEQA Guidelines section 15061(b)(3)), and exempt under the Class 8 (Section 15308) exemption for actions taken by regulatory agencies to assure the maintenance, restoration, enhancement, or protection of the environment.
