Reasons for Exemption
In accordance with §15060 (Preliminary Review) of the California Environmental Quality Act (CEQA), the Planning Division conducted an environmental evaluation in connection with proposed Conditional Use Permit 24-04 and concluded that the proposed is exempt under Section 15303 (New Construction of Small Structures) of CEQA. A Class 3 Categorical Exemption consists of projects that consist of construction and location of limited numbers of new, small facilities or structures. The project is within an urbanized area in which the exemption applies to a restaurant not involving the use of significant amounts of hazardous substances, and not exceeding 2,500 square feet in floor area. Furthermore, Conditions of Approval will be imposed to alleviate potential impacts and there are no additional potential significant environmental impacts that may result from the proposed development and establishment of the proposed project.
