Reasons for Exemption
The proposed Ordinance to update provisions for emergency shelters, Low Barrier Navigation Centers, transitional housing, and supportive housing to conform to state requirements is evaluated to be exempt pursuant to Section 15061(b)(3) of the California Environmental Quality Act (“CEQA”) Guidelines, on the basis that it can be seen with certainty that there is no possibility that the proposed amendments may have a significant effect on the environment, as they do not allow any uses not already permitted in the above zones, and they establish objective standards for emergency shelters that will help reduce potential adverse impacts on surrounding properties. They also do not approve any land use entitlements for specific projects, and would permit uses that are deemed to be “by right” and non-discretionary by state law and not considered to constitute a “project” for the purposes of CEQA. Additionally, the proposed ordinance is required for compliance with state law and would implement the goals and programs of the 2023-2031 Housing Element, which the City Council previously determined at the time of adoption to be exempt from CEQA under Section 15061(b)(3) of the CEQA Guidelines, as the policies and programs therein do not have the potential of creating significant environmental effects.
