Section 15301 Existing Facilities (Class 1): The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. Based on bids received, the Port would enter into contracts with contractors to perform the repair, rehabilitation, and/or replacement of existing Port-wide underground wet utilities, including potable water, sanitary sewer, and storm drain systems under the existing Harbor Development Permit (HDP) 23-039 issued in August 2023 for routine maintenance, repair, and rehabilitation activities within the Harbor District. The project involves negligible or no expansion of existing or former use. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption in CEQA Guidelines Section 15301 (Existing Facilities); Therefore, the Project is exempt from CEQA and no further environmental review is required.

Section 15302 Replacement or Reconstruction (Class 2): The Class 2 Categorical Exemption consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. Based on the bids received, the Port would enter into contracts with contractors for work involving the repair rehabilitation, and/or replacement of Port-wide wet utility infrastructure under the existing HDP 23-039 issued in August 2023 for routine maintenance, repair, and rehabilitation activities within the Harbor District. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption in CEQA Guidelines Section 15302 (Replacement or Reconstruction); Therefore, the Project is exempt from CEQA and no further environmental review is required.

Activities under the On-Call Services for Underground Wet Utilities may involve trenching to conduct the repair, rehabilitation, and/or replacement of Port-wide wet utility infrastructure, where the trench will be backfilled and the surface restored to match surrounding conditions. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15304(f) (Minor Alterations to Land); Therefore, the Project is exempt from CEQA and no further environmental review is required.
