Document Description
The Board of Harbor Commissioners authorized the Chief Executive to execute a settlement agreement with Long Beach Generation, LLC (LBG) to resolve all outstanding stormwater runoff claims presented in connection with the Gerald Desmond Bridge Replacement Project. The Port will maintain existing stormwater runoff Best Management Practices (BMPs), and install, inspect, and maintain, and replace BMPs along the perimeter of the Long Beach Generation Station and remove sediments conveyed onto the property in the event of a documented BMP failure.

Section 15301 Existing Facilities (Class 1): The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project involves the execution of a settlement agreement with Long Beach Generation, LLC. The Port will maintain existing stormwater runoff Best Management Practices (BMPs), and install, inspect, and maintain, and replace BMPs along the perimeter of the Long Beach Generation Station and remove sediments conveyed onto the property in the event of a documented BMP failure. The project involves no expansion of existing or former use.
The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) foreclose the use of the categorical exemption CEQA Guidelines Section 15301 (Existing Facilities); Therefore the Project is exempt from CEQA and no further environmental review is required.
