Reasons for Exemption
The project is exempt from the requirements of the California Environmental Quality Act (CEQA) under the general rule exemption or common-sense exemption of the State CEQA Guidelines Section 15061(b)(3). The proposed request is only for a two-year time extension for an already approved project. As such, all existing conditions of approval for the project will remain the same. Additionally, the proposed use conforms to the 2040 General Plan and the Railroad Avenue Specific Plan (RASP), and the Pittsburg Municipal Code (PMC). Therefore, where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA, under Section 15601 (b)(3).
