Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
Class 14, Section 15314
Reasons for Exemption
Based on the number of proposed new classrooms (fewer than 10) and that the new facilities would not increase enrollment by greater than 25%, a CEQA Categorical Exemption (Cat-Ex) would to be applicable to the Proposed Project. Section 15314 of the CEQA Guidelines states that a Class 14 exemption from CEQA consists of minor additions to existing schools within existing school grounds where the addition does not increase original student capacity by more than 25 percent or 10 classrooms (whichever is less). As the new classrooms would be located on the southeast side of the school near the existing kindergarten classroom facilities requiring only the removal of one existing portable, no exceptions listed under Section 15300.2 of the CEQA Guidelines to the exemption would apply.
