Reasons for Exemption
The project is exempt pursuant to Section 15061(b)(3) because no specific development is authorized by the adoption of Nexus Study, the Capital Improvement Program ("CIP"), or the Development Impact Fees ("DIFs"). The CIP is a prioritizing & funding allocation program and does not have the potential to cause a significant effect on the environment. No physical activity will occur until environmental review is conducted at the time projects identified in the CIP are undertaken (future unspecified date). Furthermore, adoption sets forth procedures for determining fees for purpose of obtaining funds for projects and equipment necessary to maintain service within existing service areas and is exempt pursuant to Section 15723(a)(4). Lastly, the project is exempt from Section 15378(b)(4) because the CIP is not a project as defined by CEQA.
