Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a commercial cannabis cultivation license. The Project would operate 7,436 square feet (sf) of mature outdoor cannabis canopy cultivation, 440 sf of immature canopy, and 2,504 sf of support structures. This will occur on a 7.5-acre parcel within the Dutton Creek-Trinity River watershed (HUC 12 180102111101). The Project site is zoned as Rural Residential 5 Acre minimum (RR5), and its Trinity County General Plan land use designation is Rural Residential (RR). The cultivation is composed of 82 7’x7’ fabric pots, 40 5’x5’ planter boxes, 129 4’x4’ planter boxes, seven 4’x8’ beds, and one5’x26’ bed. Water for the Project would be provided from an onsite well. An onsite septic system would serve the Project’s domestic wastewater needs.

The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
