This project is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The County of San Luis Obispo determines that it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment; the activity is not subject to CEQA. [Reference: State CEQA Guidelines sec. 15061(b)(3), Common Sense Exemption] These amendments are exempt from the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that it will have a significant effect on the environment (CEQA Guidelines §15061 (b)(3)), will not result in a direct or reasonably foreseeable indirect physical change in the environment (CEQA Guidelines § 15060(c)(2)), consists of regulations to streamline the public abatement, cost recovery and administrative fine process related to cannabis activities to assure the maintenance, restoration, or enhancement of natural resources and the environment (Class 7 and Class 8, CEQA Guidelines §§15307, 15308), and relates to the enforcement of laws, general rules, standards, or objectives, administered and adopted by the County (Class 21, CEQA Guidelines §15321). The County of San Luis Obispo Department of Planning and Building has reviewed the proposed activity and has identified that it qualifies for an exemption from CEQA pursuant to Section 15061 (b)(3) (Common Sense Exemption) of the State CEQA Guidelines (Chapter 3 of Division 6 of Title 14 of the California Code of Regulations) and has determined that the proposed activity will not have a significant effect on the environment. The proposed ordinance amendments qualify for a Common-Sense Exemption because it can be seen with certainty that there is no possibility that it will have a significant effect on the environment (CEQA Guidelines §15061 (b)(3)), will not result in a direct or reasonably foreseeable indirect physical change in the environment (CEQA Guidelines §15060(c)(2)), consists of regulations to streamline the public abatement, cost recovery and administrative fine process related to cannabis activities to assure the maintenance, restoration, or enhancement of natural resources and the environment (Class 7 and Class 8, CEQA Guidelines §§15307, 15308), and relates to the enforcement of laws, general rules, standards, or objectives, administered and adopted by the County (Class 21, CEQA Guidelines §15321).
