Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number EPIMS-TRI-45767-R1, pursuant to Section 1602 of the Fish and Game Code to Mr. Robert Ruffino. The project is limited to two encroachments. Both encroachments are to decommission unpermitted water diversions from unnamed tributaries to the South Fork Trinity River. Water was diverted for domestic use and irrigation. Work will include removal of all associated water diversion infrastructure to resolve Fish and Game Code violations described in a notice of violation (Certified Mail # 7022 2410 0001 7380 3932), dated August 23, 2023.

Reasons for Exemption
The project will authorize removal of two existing but unpermitted surface water diversions and improving road surface drainage near a stream that require minor alteration of land. Work on existing facilities was conducted without a Streambed Alteration Agreement (Fish & Game Code [FGC] Section 1602). There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
