Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-LAN-48124-R5, pursuant to Section 1602 of the Fish and Game Code to The Salvation Army, as represented by Jay Koebel.
The Project is limited to concrete removal along a portion of the western bank of Malibu Creek using hand tools and a small excavator pursuant to a California Coastal Commission Cease and Desist Order No. CCC-14-CD-04 and Consent Restoration Order No. CCC-14-RO-04. Larger concrete slabs that do not compromise the integrity of the bank and the adjacent fire service road on top of the bank will be removed with the small excavator. The excavator will be placed to the west of the bank along the existing fire service road. Any slabs of concrete that might compromise the integrity of the bank if removed will be left in place. Smaller slabs of concrete, and other loose materials such as rebar, will be removed by hand. Concrete removal areas will be revegetated with native plantings.

Reasons for Exemption
Section 15321 describes enforcement actions by regulatory agencies. This Project is being ordered pursuant to the California Coastal Commission Cease and Desist Order No. CCC-14-CD-04 and Consent Restoration Order No. CCC-14-RO-04. Section 15333 describes small habitat restoration projects.
Specifically, 15333(d)1 which is the revegetation of disturbed area with native species. This Project is to remove concrete from the bank of Malibu Creek and revegetate those areas with native plants.
