Document Description
The Board of Education of the Moreno Valley Unified School District (“Board of Education”) adopted Resolution No. 2023-24-125 to thereby authorize the closure of March Valley HS due to enrollment being less than fifty percent of the 110 student program capacity. March Valley HS students may elect to transfer to March Mountain HS (in effect staying on the same campus), and existing capacity at March Mountain HS is sufficient to accommodate all of the March Valley HS students. March Valley HS students also may elect to transfer to their respective home schools, and existing capacity at those home schools is sufficient to accommodate all March Valley HS students who elect to transfer to their respective home schools.

Public Resources Code Section 21080.18 provides that CEQA requirements are inapplicable to the closing of any public school in which kindergarten or any of grades 1 through 12 is maintained or the transfer of students from that public school to another school if the only physical changes involved are categorically exempt under Chapter 3 (commencing with Section 15000) of Division 6 of Title 14 of the California Administrative Code. 14 CCR Section 15314 sets forth a categorical exemption for minor additions to existing schools within existing school grounds where the addition does not increase original student capacity by more than 25% or ten classrooms, whichever is less. See San Lorenzo Valley Community Advocates for Responsible Education v. San Lorenzo Valley Unified School District (2006) 139 Cal.App.4th 1356; 44 Cal.Rptr.3d 209.
