Reasons for Exemption
Exemption Criteria Conformance Evaluation (Class 1): The entire footprint of the area to be replanted is within the footprint of the vineyard as it existed on June 16, 1993, and proposed Block 7 is also within the footprint of the vineyard as on the approved erosion control plan #P11-00005-ECPA. With the assumption that the specified cover levels will be maintained, the amount of sediment delivered from the proposed new and replanted vineyard blocks would not be increased beyond current levels or the USDA soil loss tolerance level. The Napa County Engineering Division confirmed technical adequacy of the soil loss and runoff studies on May 31, 2024. The footprint of the area to be replanted within one parcel totals approximately 20.9 gross acres (17.9 net acres) of vineyard. The proposed replant would replace existing vineyard and would not result in an increase in groundwater demand. Exemption Criteria Conformance Evaluation (Class 4): The vineyard replant in Blocks 8A-C is approximately 1.2 gross acres in area, with an average slope of 13.8%. See attached correspondence with Rich Paxton dated June 5, 2024. The vineyard conversion is proposed in the Mill Creek drainage, which is known to have been less than 5 ½% converted to vineyard since June 16, 1993. Approximately 3.8% of the Mill Creek drainage has been converted to vineyard since 1993. The proposed replant of 1.2 acres of vineyard would be irrigated by groundwater. The original development of Blocks 8A-C occurred sometime around 2005, and was authorized under a sequence of approvals related to the winery (refer to project record). A Phase I Water Availability Analysis was prepared for the #P11-00005-ECPA, and accounts for the water use associated with Blocks 8A-C as an existing condition. Replant of these blocks would not increase existing groundwater demand. The vineyard conversion is proposed in an area located greater than ½ mile from the nearest active or potentially active mine or quarry or designated Mineral Resource Area. The nearest mineral resource area, active or potentially active mine or quarry is over 25 miles from the project site.
