The project involves contracts with contractors to perform the repair, rehabilitation, and/or replacement of existing Port-wide wet utilities infrastructure under existing HDP 23-039 issued in August 2023. The project involves negligible or no expansion of existing or former use. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15301 (Existing Facilities); therefore the Project is exempt from CEQA and no further environmental review is required.

Section 15302 Replacement or Reconstruction (Class 2): The Class 2 Replacement or Reconstruction Categorical Exemption consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The Port would enter into contracts with contractors for work involving replacement of wet utilities structures including potable water pipes, valves, hydrants, sewer pipes, manholes, storm drain lines, catch basins and other appurtenances. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15302 (Replacement or Reconstruction); therefore the Project is exempt from CEQA and no further environmental review is required.

On-call emergency wet utilities services performed by contractors selected would potentially involve trenching and excavation to repair, rehabilitate, and/or replace wet utilities where the surface is restored. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15304 (Minor Alterations to Land); therefore the Project is exempt from CEQA and no further environmental review is required.
