Document Description
The California Department of Fish and Wildlife has executed Streambed Alteration Agreement number EPIMS-SIS-42541-R1, pursuant to Section 1602 of the Fish and Game Code to Tom Hayden Ranch, represented by Kory Hayden. The project is limited to activities associated with 1) the diversion of water from Patterson Creek at a single point of diversion, 2) maintenance of the diversion, 3) vegetation removal within Patterson Creek, and 3) non-commercial gravel extraction for personal use on the ranch property. The Permittee diverts water from Patterson Creek pursuant to Decree #30662 of the Superior Court of the State of California (Decree) in and for the County of Siskiyou judgement for Scott River, and and/or riparian claimed water right to the SWRCB Division of Water Rights. The Permittee operates the point of diversion for themselves and Arleen Earnest and Sher Haley for a maximum total of 6.0 cfs of water year around for domestic and stock water use, and from April 1 to October 15 to include irrigation at this single point of diversion. Surplus conditions do exist as outlined in the Decree. Maintenance of the diversion may include repair of the rock weir, ditch intake, fish screen, fish screen bypass return to stream, and/or removal of sediment or vegetation in the vicinity of the diversion which may impact water being diverted. Permittee may remove debris and excess sediments from the immediate vicinity of the point of diversion. At no time will heavy equipment be operated in the active stream channel. Any work requiring manipulation of the bed, bank, or channel and/or use of heavy equipment will be done with a work plan approved, in writing, by CDFW prior to work commencing.
