Document Description
On June 11, 2024, the Board of Directors of East Bay Municipal Utility District (Board) adopted revisions to water and wastewater system rates, charges, and various fees not subject to Proposition 218, and to water service regulations for Fiscal Year (FY) 2025. Water and wastewater rates, charges, and fees and_ water service regulations are applicable to the EBMUD service area as shown In Exhibit 1. Real property use application fees are applicable to request for use of EBMUD properties located in the EBMUD service area (shown in Exhibit 1) and In Amador, Calaveras, and San Joaquin Counties (shown in Exhibits 2 and 3). The changes to the recreation use fees apply to EBMUD recreation facilities in the EBMUD service area (shown in Exhibit 1 and in Amador, Calaveras, and San Joaquin Counties (shown In Exhibits 2 and 3). Reasons for Exemption
The Board's adoption of water and wastewater system rates and charges, various fees and regulations for FY 2025 is exempt from the requirements of CEQA because It consists entirely of the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, or other charges necessary to (1) meet District operation expenses, including employee wage rates and fringe benefits, (2) purchase or lease supplies, equipment or materials, (3) meet financial reserve needs and requirements, and (4) obtain funds for capital projects necessary to maintain service within the District’s existing service area. The Board's adoption of these rates, charge&, various fees, and regulations is also exempt from the requirements of CEQA because there is no possibility that their adoption will have a significant effect on the environment. All of the rates, charges, and fees adopted by the Board were designed to support the Districts’ operating and capital expenses.
