Section 15301 Existing Facilities (Class 1): The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project involves the authorization to spend $3,375,000 to complete the design of the SLS 101 Backup Generator project. The construction activity involves installation of a backup generator, wiring, and generator heaters as well as constructing an asphalt entrance/exit driveway at an existing facility under existing HDP 23-045 issued in October 2023. Therefore, the project involves negligible or no expansion of existing or former use. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15301 (Existing Facilities); therefore the Project is exempt from CEQA and no further environmental review is required.

Section 15302 Replacement or Reconstruction (Class 2): The Class 2 Categorical Exemption consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The project involves replacing a manual switch with an automatic transfer switch, which will have the same purpose and capacity as the switch being replaced. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15302 (Replacement or Reconstruction); therefore the Project is exempt from CEQA and no further environmental review is required.
